These Terms of Service ("Terms") govern your use of the website investiming.com and related services (the "Service") provided by Sebastián Taramona Fernández ("Investiming", "we", "us").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Investiming is currently in a pre-commercial phase. The Service is provided free of charge until paid access launches. Full legal identification of the service provider, including registered address and tax identification number, will be added before the launch of paid access.

1. Description of the Service

Investiming provides statistical analysis of historical market data for eight major assets: Bitcoin (BTC), Ethereum (ETH), S&P 500, Nasdaq, Gold, Silver, Tesla and NVIDIA.

The Service displays metrics such as the historical extension percentile of current market movements, dual readings, and ratios derived from past similar movements.

The Service is not financial advice. Investiming does not provide investment recommendations, does not predict future prices, and does not solicit the purchase, sale or holding of any asset. The Service describes statistical and historical state for informational purposes only. All decisions remain the sole responsibility of the user.

2. User accounts

To access the full dashboard and future paid features, you must create an account.

Requirements:

Be at least 14 years old.
Provide a valid email address.
Maintain the confidentiality of your credentials.

Your responsibilities:

You are responsible for all activity under your account.
You must notify us promptly of any unauthorized access at privacy@investiming.com.
You may not share your credentials or transfer your account to another person.

Our rights:

We reserve the right to suspend or terminate accounts that violate these Terms, including but not limited to fraudulent activity, abuse of the Service, or breach of intellectual property obligations described below.

3. Acceptable use

You agree not to:

Scrape, crawl, or extract data from the dashboard or any non-public part of the Service through automated means.
Share account credentials with third parties.
Modify any downloaded export from the Service (charts, screenshots, dashboard captures) to remove the watermark, the disclaimer, or the attribution to investiming.com.
Re-publish content from the Service while presenting it as your own.
Use the Service in ways that disrupt or place excessive load on the system.
Use the Service in violation of any applicable law.

4. Intellectual property

Ownership. All content available on the Service (data visualizations, methodology, the underlying detection logic, branding and design) is the intellectual property of Investiming and is protected by Spanish and international copyright and intellectual property laws.

Permitted use. You may share downloaded exports from the Service (charts, screenshots) intact, retaining the watermark, the disclaimer and the attribution to investiming.com. This includes sharing on social media and personal communication.

Prohibited use. You may not:

Modify exports to remove watermark, disclaimer or attribution.
Re-publish content presenting it as your own work or as work of a third party.
Reverse-engineer the methodology, the pivot detection logic, or any other proprietary aspect of the Service.
Use the methodology or its outputs to build derivative commercial products.

5. Founding member status (pre-commercial offer)

Users who register before the launch of paid access automatically receive Founding member status.

What it grants: when paid access launches, founding members will be able to subscribe at a permanent rate of €10/month (or annual equivalent), instead of the standard rate of €12/month (or annual equivalent).

Conditions:

The €10/month rate is preserved for as long as the subscription remains continuously active.
If a founding member cancels their subscription, they lose founding member status. Upon resubscription, standard pricing applies.
The offer applies to all features available under standard paid access at the time of launch.

Reserved rights: Investiming reserves the right to modify the conditions of the founding member offer with at least 30 days' notice via email to registered users, provided that changes do not retroactively affect founding members who are already subscribed at the time of the change.

6. Financial disclaimer

The Service provides statistical and historical analysis of market data. It does not constitute financial, investment, tax or legal advice, nor an offer or solicitation to buy, sell or hold any financial instrument. See also our Privacy Policy for how personal data is handled.

Past performance and historical statistical patterns do not guarantee future results. Investment decisions involve risks including potential loss of capital. You should consult a qualified financial advisor before making investment decisions.

Investiming makes no warranty regarding the accuracy, completeness, or timeliness of the data presented. Data may be subject to delays, gaps or errors.

7. Limitation of liability

To the maximum extent permitted by law:

The Service is provided "as is" and "as available", without warranties of any kind.
Investiming is not liable for any direct, indirect, incidental, consequential or special damages arising from your use of the Service, including but not limited to financial losses, lost profits, or losses derived from investment decisions made on the basis of information provided by the Service.
Investiming does not guarantee uninterrupted availability of the Service.

Cap on liability: in any event, the total aggregate liability of Investiming towards a user is limited to the total amount paid by that user to Investiming over the twelve months preceding the event giving rise to the liability. During the pre-commercial phase, where no payment is made, no monetary liability applies.

Nothing in these Terms limits liability that cannot be excluded under applicable law (such as fraud, willful misconduct, or statutory consumer rights).

8. Suspension and termination

By you. You may close your account at any time from your account dashboard, or by sending a request to privacy@investiming.com. Your data will be handled according to the Privacy Policy.

By Investiming. We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or otherwise compromise the integrity or security of the Service. Where possible, we will provide notice and an opportunity to remedy the breach.

Effect of termination. Upon termination, your right to access the Service ends. Sections of these Terms that by their nature should survive termination (intellectual property, limitation of liability, governing law) remain in effect.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified to registered users by email at least 30 days before they take effect. The current version is always available at investiming.com/terms with the last updated date at the top.

Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

A specific update will occur when paid access launches: at that point, full legal identification of the service provider (including registered address and tax identification number) will be added, along with payment terms, refund policy, and trial conditions.

10. Governing law and jurisdiction

These Terms are governed by Spanish law.

Any dispute arising from these Terms or from the use of the Service shall be submitted to the courts of Madrid, Spain, except where mandatory consumer protection rules grant the user the right to bring proceedings in their country of residence.

EU consumers may also access the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
